Policy Title
Minimum Necessary Disclosure of Protected Health Information Policy
Policy Statement
Pursuant to 45 CFT 164.502(b) Life University requires minimum necessary disclosure as relates to disclosure of personal health information. When using or disclosing protected health information reasonable efforts must be made to limit protected health information to the minimum necessary to accomplish the intended purpose of the use, disclosure or request.
Minimum necessary disclosure does not apply to the following:
- Disclosures to or requests by a health care provider for treatment;
- Disclosures of PHI to the patient or the patient’s legally authorized representative;
- Uses or disclosures of PHI made pursuant to an authorization signed by the patient or the patient’s legally authorized representative;
- Uses or disclosure of PHI that are required by law; and/or
- Uses or disclosures that may be required for compliance with HIPAA (including disclosures made to the U.S. Department of Health and Human Services in response to an investigation of compliance with HIPAA).
